Lindsay Lohan sues E-Trade over ‘milkaholic baby’ Super Bowl commercial

Lindsay Lohan is suing an online share trading firm for $100m, claiming that a “milkaholic” baby named Lindsay it cast in a television advertisement was modelled on her.

The 23-year-old actress and singer, who has convictions for cocaine possession and drink-driving, alleges that E-Trade breached her rights by casting a character who shares her first name.

The humorous commercial was first broadcast during last month’s Super Bowl and features a spoof video chat between a baby boy and girl couple.

At one point the girl demands to know whether her boyfriend has been spending time with “that milkaholic Lindsay”, prompting a second girl to lean in front of the camera and slur the words “milk-a-what?”

The Hollywood actress’s legal team claim that the name Lindsay sent a “subliminal message” to viewers that the character was based on Lohan.

Papers filed at the Nassau County Supreme Court in New York allege that E-Trade used Lohan’s “name and characterization” without approval. She is demanding $100m in damages and for the advert to be withdrawn.

Stephanie Ovadia, Lohan’s lawyer, told the New York Post: “Many celebrities are known by one name only, and E-Trade is using that knowledge to profit.

“They used the name Lindsay. They’re using her name as a parody of her life. Why didn’t they use the name Susan? This is a subliminal message. Everybody’s talking about it and saying it’s Lindsay Lohan.”

E-Trade has yet to issue a response to the allegations. But a spokesman for Grey Group, the marketing and advertising agency which produced the commercial, insisted that the Lindsay in the clip was named after one of its own members of staff.

Lohan has barely been out of the headlines in recent years, thanks to repeated spells in rehab and her high-profile relationship with DJ Samantha Ronson. The couple split up last April.
